EPA trying to “put Humpty Dumpty back together again” with new RFS proposal

The EPA has proposed a supplemental rule to address outstanding small refinery exemptions.

Renewable Fuels Association CEO Geoff Cooper tells Brownfield the agency is trying to clean up unresolved issues related to the Renewable Fuel Standard (RFS).

“They’re dealing with various court decisions and standards that were late in being published, so a lot of what EPA is doing right now is trying to put Humpty Dumpty back together again and get the RFS back on track.”

He says EPA’s proposal deals with exempted volumes that should’ve been blended by small refineries the last three years.

“So yesterday’s proposal says ‘yes, we do intend to reallocate that exempted volume. We intend to add it back to the 2026 and 2027 standards.”

Cooper says EPA is proposing to reallocate either half or all the exempted volumes.

“They also asked for comments on whether they should look at other amounts. But of course we are going to be arguing that EPA has a duty (and) responsibility to reallocate all of that exempted volume.”

EPA will be conducting a public hearing on the proposed SRE rule, followed by a 30-day public comment period.

  • Fully reallocate all excempted volumes . The more sustainable fuels the better. Soybean and corn markets low prices are killing the agricultural economy. Anti trust laws need to be enforced. Our food security needs competition. To few large corporations are stifling billions of dollars that be flowing thru our agricultural economy.
