John Deere wins green and yellow trademark suit

John Deere combine at John Deere Pavilion in Moline, IL
A U.S. District Court says there can only be one green and yellow ag equipment manufacturer. John Deere took FIMCO, Inc. of South Dakota to court for using the trademark colors on its agricultural sprayers. The Paducah, Kentucky judges heard the case in June and just ruled in favor of John Deere.
Moline, Illinois-based John Deere claimed that use of the colors by another manufacturer confuses the public as to where the product originated and dilutes the value of the John Deere brand. The U.S. District Court just issued a 107-page decision and ruled in favor of John Deere on all its claims.
The court gave FIMCO 60 days to file a plan on how it intends to comply with the ruling.
