NPPC/AFBF petition SUPCO to take their case against CA Prop 12

The National Pork Producers Council and American Farm Bureau have petitioned the U.S. Supreme Court to take their case against California’s Proposition 12 because of its  ‘arbitrary’ production standards that would ban the sale of pork from hogs that don’t meet them.

They’re appealing the Ninth circuit court decision in July that upheld a lower court ruling against NPPC and Farm Bureau which said the circuit didn’t have precedent to continue the case.

NPPC President Jen Sorensen says they’re asking the high court to consider the constitutionality of one state imposing far-reaching regulations outside its borders. Farm Bureau President Zippy Duvall says supporters of Prop 12 claim it would improve animal welfare and food safety but it fails to do either of those. He says farmers know the best way to care for their animals and that small family farms will be hit the hardest if forced to make expensive and unnecessary changes to their operations – leading to further industry consolidation.
