Ohio Farm Bureau files brief with U.S. Supreme Court
The Ohio Farm Bureau is asking the U.S. Supreme Court to hear their case on eminent domain.
Ohio Farm Bureau Policy Counsel Leah Curtis says this could set a precedent for cases in the future.
“Can a state be sued in federal court when they take property and don’t provide compensation for it? As Ohio does not have a way to file an inverse condemnation claim in the state court, having the federal court available would be a good option for our members,” she says.
She tells Brownfield this isn’t the first time a case like this has appeared in the Supreme Court.
“This case is somewhat related to a case that we filed a number of years ago called Knick vs. Scott Township that was also an eminent domain case, and that case dealt with some long-standing precedent that essentially closed the federal courthouse doors for any takings came and it said you had to go to state court first,” she says.
Curtis says if the court accepts the case, a decision is expected to be made sometime next year.
