Tariff ruling could hinge on revenue vs. trade authority, Bacon says

The U.S. Supreme Court’s ruling on President Trump’s tariff policy could come as early as this week.

Nebraska Republican Don Bacon, a member of the House Ag Committee, says the president’s tariffs have put pressure on the ag industry.

“What the president did, putting tariffs on 80 different companies with an average of 20%, I think that has been some dead weight on our economy,” Bacon said.

He tells Brownfield the Supreme Court could partially reject the administration’s actions.

“The president keeps talking about how much revenues we’re pulling in,” Bacon said. “And that plays into the hands of it being overturned because the Supreme Court has made it pretty clear that if it’s about revenues it should be Congress driven and not presidential driven.”

However, Bacon says, “If this is about negotiating a trade deal, then it’s Article II, presidential powers.”

The court’s next opinion day is Wednesday.
