16 states sue Corteva, Vylor over alleged PFAS liability transfer

Sixteen states have filed a lawsuit against Corteva’s seed and genetics spinoff company, Vylor.

Filed in a Marion County, Indiana state court, the lawsuit claims Corteva illegally transferred billions of dollars in assets to Vylor while leaving behind potential PFAS-related liabilities tied to former parent company, DuPont. Corteva was created in 2019 through the merger of DuPont and Dow Chemical.

The Indiana Attorney General’s Office says the move could make it harder for states to receive damages linked to PFAS contamination. 

In a statement to Brownfield, Corteva says, “This lawsuit is entirely without merit and based on faulty claims, many of which have already been rejected in district court. We are confident in our position and look forward to defending ourselves in court.”

Alaska, Florida, Maine, Maryland, Massachusetts, New Hampshire, New Mexico, Oregon, Pennsylvania, Rhode Island, Tennessee, Texas, Vermont, and Washington are all included in the lawsuit.

The lawsuit was filed on the same day Corteva officially launched Vylor.
