Syngenta vs. grain handlers dismissed
Syngenta’s countersuit against grain handlers exporting Agrisure Viptera corn to China has been dismissed.
U.S. District Court Judge John Lungstrum dismissed Syngenta’s claims that ADM, Cargill and Rail Transfer Inc. were also responsible for comingling corn traits unapproved by China that resulted in China rejecting several shipments of the grain. The judge ruled Syngenta’s claims were preempted by the U.S. Grain Standards Act.
Farmers are still suing Syngenta for financial losses, arguing Syngenta’s negligence reduced the price for corn and caused economic hardship for U.S. growers and others in the industry.
