Wisconsin Supreme Court upholds Livestock Facilities law

The Wisconsin Supreme Court has ruled a township cannot impose tougher water quality standards than the state has. In 2007 the Town of Magnolia in Rock County granted Larson’s Acres a permit to expand their dairy farm from 1,000 to 2,900 head but with the stipulation the farm allow monthly water quality tests and follow a certain crop rotation.

Larson’s filed suit arguing the township did not have the authority to exceed state standards in the permitting process. The high court agreed. The ruling upholds Wisconsin’s Livestock Facilities Siting Law.

Similar suites have been filed in Illinois, Indiana, Minnesota, Nebraska, Ohio and Oklahoma.
